Terms of Service – PGN to Video (powered by Chess Converter)
Purpose
These Terms of Service (the “Terms”) govern the access to and use of the online service named “PGN to Video” (the “Service”), made available via the website https://chesstraining.com.
The Service allows users to convert a chess game in PGN format into a video, including audio commentary generated automatically by artificial intelligence.
The Service relies on a proprietary technology named “Chess Converter”, developed and owned by Goldgewicht Consulting.
Service Provider
The Service is operated by Goldgewicht Consulting, a French company registered with the Paris Trade and Companies Register under number 823 517 578, with its registered office located at 75 avenue Parmentier, 75011 Paris, France.
Acceptance of the Terms
Access to and use of the Service are subject to the prior, express and unreserved acceptance of these Terms.
Acceptance is materialized by a positive action from the user consisting in checking a dedicated box stating “I accept the Terms of Service” before submitting a PGN file and before any video generation.
If the user does not accept the Terms, access to the Service and its features is not permitted.
Description of the Service
The Service is an online tool that converts a chess game in PGN format into an animated video with audio commentary.
The audio commentary is automatically generated using text-to-speech technologies based on artificial intelligence, from the textual comments contained in the PGN file.
The audio content generated by the Service is artificial intelligence–generated content and does not correspond to a real human voice. The generated content does not reflect any human intention, opinion or position.
Videos generated by the Service are made available to the user for a limited period of time. Goldgewicht Consulting does not guarantee the storage, archiving or availability of videos beyond this period. It is the user’s responsibility to download and save the generated videos.
The Service is accessible via https://chesstraining.com, including through dedicated tool pages.
Access to the Service
The Service is accessible online via a compatible web browser. Goldgewicht Consulting makes reasonable efforts to ensure availability of the Service but does not guarantee uninterrupted or error-free access.
User Obligations
The user agrees to use the Service for personal, creative and informational purposes only.
The Service is not intended for professional, commercial, critical or regulated uses. The user acknowledges that the Service must not be used in contexts requiring a high level of reliability, accuracy or guaranteed performance.
The user is informed that the audio commentary generated by the Service is generated by artificial intelligence. When distributing, sharing or making available the generated videos to third parties or end users, the user undertakes to clearly and unambiguously indicate that the audio commentary has been generated by artificial intelligence.
The user agrees to comply with all applicable laws and regulations and not to infringe any third-party rights, including intellectual property rights.
The user warrants that they hold all necessary rights and authorizations over the data, PGN files and content uploaded or used through the Service.
Intellectual Property
7.1 Rights of Goldgewicht Consulting
The Service and all of its components (including software, source code, algorithms, features, databases, trademarks, logos, designs, texts and graphics), as well as the proprietary “Chess Converter” technology, are protected by intellectual property laws and remain the exclusive property of Goldgewicht Consulting or its partners.
Any unauthorized reproduction, representation, modification, adaptation or exploitation of the Service or any of its elements is strictly prohibited.
7.2 User Content
The user retains ownership of the PGN files and content they upload to the Service.
The user acknowledges that the videos generated by the Service constitute derivative works resulting from the combination of user content and the Service’s technical processes.
7.3 License to Generated Videos
Subject to compliance with these Terms, Goldgewicht Consulting grants the user a personal, non-exclusive, non-transferable and non-commercial license to use the generated videos.
This license expressly authorizes:
personal or informational sharing on non-commercial websites or social media platforms;
the creation of entertainment content, including meme-style content;
non-commercial educational or editorial uses.
Any commercial, advertising or revenue-generating use of the generated videos is strictly prohibited without prior written authorization from Goldgewicht Consulting.
7.4 License Granted to Goldgewicht Consulting
For the sole purpose of operating, maintaining, securing and improving the Service, the user grants Goldgewicht Consulting a free, non-exclusive and worldwide license to technically process and reproduce the uploaded content and generated videos for the duration strictly necessary to provide the Service.
Personal Data
Goldgewicht Consulting processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
The Service may collect the user’s email address for the following purposes:
user support and assistance;
communications related to the operation of the Service;
information about updates and new features.
The legal basis for these processing activities is the performance of the contract and Goldgewicht Consulting’s legitimate interest. Users may object at any time to receiving communications about new features.
Any data contained in files uploaded by the user is processed solely for the purpose of providing the Service and is not commercially exploited.
Personal data is retained only for the period strictly necessary to achieve the stated purposes.
Disclaimer of Warranties
The Service is provided “as is” and “as available”, without any express or implied warranty.
Goldgewicht Consulting does not guarantee the accuracy, quality or relevance of generated videos or audio content, nor the absence of errors, interruptions or bugs.
Generated videos are provided in a widely used standard format. Video playback depends on the software, hardware and environment used by the user.
Limitation of Liability
To the maximum extent permitted by applicable law, Goldgewicht Consulting shall not be liable for any indirect, incidental, special, consequential or immaterial damages, including loss of data, loss of revenue, loss of profits, business interruption or reputational harm.
In any event, and except in cases of gross negligence or mandatory legal provisions, the total liability of Goldgewicht Consulting shall be strictly limited to the amount paid by the user for the Service during the twelve (12) months preceding the event giving rise to liability, or to one (1) euro if the Service is provided free of charge.
Some jurisdictions do not allow certain limitations of liability. In such cases, liability shall be limited to the maximum extent permitted by applicable law.
Any claim or action must be brought within twelve (12) months of the event giving rise to the claim.
Force Majeure
Goldgewicht Consulting shall not be liable for failure or delay resulting from events beyond its reasonable control, including force majeure events as defined by applicable law.
Termination
These Terms apply for the duration of the user’s use of the Service.
The user may stop using the Service at any time.
Goldgewicht Consulting may suspend or terminate access to the Service in case of breach of these Terms.
Goldgewicht Consulting may also modify, suspend or discontinue, temporarily or permanently, all or part of the Service and/or its underlying technology, at any time, without prior notice and without liability.
Governing Law and Jurisdiction
These Terms are governed by French law.
Any dispute relating to their interpretation or execution shall fall within the exclusive jurisdiction of the competent French courts.
Changes to the Terms
Goldgewicht Consulting may modify these Terms at any time. The applicable version is the one in force at the time the Service is used.
